Heard Mr. Karekar, learned Advocate for Petitioners. 2.
In the present Petition, Petitioners have filed the present Petition for the following relief:- "a.
Discharge the Petitioner No. 1, Ajit Mohan Dhuru, to whom Probate has been issued on 1st June 2023 by this Hon'ble Court, from his role as co-executor as regards the Will dated 11th May 2015 of the Deceased, and appoint Petitioner No. 2, Shankar Krishna Salaskar, to be the sole continuing Executor thereunder."

I am informed that Grant has been issued on 01.06.2023 by this Court. There are two Executors namely Petitioner No.1 and Petitioner No.2 therein in the Grant.

Petitioner No.1 is 78 years old and due to his serious medical issues of which details are given in the Petition, Petitioner
949.MPT.526.2025.doc No.1 seeks to discharge from his role as Executor / Co-executor. Averments made in the Petition is to the effect that Petitioner No.2 who is the Co-executor shall continue as sole Executor. 5.
I have heard Mr. Karekar, learned Advocate appearing for Petitioners in the present Petition.

Considering the averments made in the Petition and the reasons given therein, there can be no impediment in allowing the Petition. Misc. Petition is allowed and disposed of in terms of prayer clause 'a' stated hereinabove.

All parties to act on a server copy of this order. 8.
