Heard Mr. Kukreja, learned Advocate for Petitioners. 2.
Present Misc. Petition is filed by Petitioners for issuance of legal heirship certificate under Section 2 of Bombay Regulation VIII of 1827 in respect of the properties and credits of deceased Mrs. Pushpa Babu Bangera. The names and details of legal heirs of the deceased are stated in paragraph No.5 of the Petition. Purpose for filing the present Petition is stated in paragraph No.7 of the Petition. I have perused the same.

Consent affidavits dated 05.07.2025 of (1)Kirankumar Narayan Moolya (Son of Late Mrs. Mohini N Moolya), (2)Vishal Narayan Moolya (Son of Late Mrs. Mohini N Moolya), (3)Narayan Babu Moolya (Husband of Late Mrs. Mohini N Moolya), (4)Rama
915.MPT.598.2025.doc Vasudev Kulal, (5) Shrinivas Babu Bangera, (6)Nagesh Babu Bangera and (7)Nagesh Babu Bangera the legal heirs are filed on record and appended at page Nos.45, 50, 55, 62, 65, 70, and 75 of Petition. 4.
In view of the above, there can be no impediment in allowing the Petition. Misc. Petition is allowed and disposed of in terms of prayer clauses 'a', 'b' and 'c' which read thus:- "'a'
That Legal Heirship Certificate thereby certifying the Petitioners (1)JAYANTHI VISHWANATH BANGERA (Daughter), (2)CHANDRASHEKAR BABU BANGERA (Son),(3) KIRANKUMAR NARAYAN MOOLYA (Grandson),(4)VISHAL NARAYAN MOOLYA (Grandson),(5)NARAYAN BABU MOOLYA {Son-in-law), (6)RAMA VASUDEV KULAL (Daughter),(7) SHRINIVAS BABU BANGERA (Son), (8) NAGESH BABU BANGERA (Son) and (9) NAVIN BABU BANGERA (Son) be recognized as legal heirs and representatives of the deceased be granted to the Petitioners; b that the delay in filing the present Petition be condoned; c Issuance of proclamation may be dispensed with;" 5.
Issuance of proclamation stands dispensed with. 6.
Department is directed to issue the legal heirship certificate as directed above within a period of 3 weeks from today positively. 7.
Misc. Petition is allowed and disposed subject to compliance of office objections, if any, forthwith which shall be allowed by the Department.
