MPT/669/2025 (E-filing) Mr. Sushil Inamdar i/b. A. B. Shrikhande, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. Ld. Advocate for petitioner has filed precipe dated 14.10.2025 for seeking exemption of court fees. In para No. 11 of the said Misc. Petition, the petitioner has stated that the Letters of Administration was filed for administering of Properties of Arun Monie and Syamala Arun Monie in TP No. 4115 of 2022 and the court fees of Rs.75,000/- is paid in the said petition and grant was issued in the said petition in respect of the properties situated in State of Maharashtra and State of Tamil Nadu. Copy of the grant is annexed to the present petition as Exhibit - "J". Both the deceased are the same persons in both the petitions. Petitioner is same person who had filed the petition for Letters of Administration.

2. The present MPT is filed in respect of immovable property mentioned at Sr. No. 26 in the Schedule of the said Letters of Administration. The same properties mentioned in the Schedule of the present petition. Since, the both the deceased and properties are same and identical, petitioner is entitled for the exemption of court fees under section 23 of the Maharashtra Court Fees Act, 1959.

3. In view of thereof, office objections regarding the court fees is dispensed with. Office to proceed as per the order dated 06.09.2025 16.10.2025 COMPANY REGISTRAR / TESTAMENTARY REGISTRAR
