Present Misc. Petition is filed by Petitioner for issuance of legal heirship certificate under Section 2 of Bombay Regulation VIII of 1827 in respect of the properties and credits of deceased Jagannath Bendre alias Jagannath Vishnu Bendre alias Jagannath V. Bendre alias Bendre Jagannath Vishnu. The names and details of legal heirs of the deceased are stated in paragraph No.4 of the Petition. Purpose for filing the present Petition is stated in paragraph Nos.6 to 9 of the Petition. I have perused the same.

Consent affidavits dated 22.08.2025 of Ganesh Jagannath

P12.MPT.698.2025.doc Bendre, Sai Bharat Mane, Rohini Pramod Rajmane, and dated 24.08.2025 of Laxmi Samrat Rao, the legal heirs are filed on record and appended at page Nos.37, 41, 45 and 49 of Petition. 5.

In view of the above, there can be no impediment in allowing the Petition. Misc. Petition is allowed and disposed of in terms of prayer clauses 'a', 'a' and 'b' which read thus:- "a) That the delay in filing the present Petition be kindly condoned in the interest of justice.

a) That a Legal Heirship Certificate be issued under the provision of Bombay Regulation Act VIII of 1827 Certifying that (1) Anandi Jagannath Bendre (Widow of the deceased and the Petitioner herein), (2) Ganesh Jagannath Bendre (Son of the Deceased), (3) Sai Bharat Mane (Married Daughter of the Deceased), (4) Rohini Pramod Rajmane (Married Daughter of the Deceased) and (5) Laxmi Samrat Rao (Married Daughter of the deceased), are the only heirs and Legal representatives of the deceased. b) Issuance of proclamation stands dispensed with." 6.

Department is directed to issue the legal heirship certificate as directed above within a period of 3 weeks from today positively. 7.

Misc. Petition is allowed and disposed subject to compliance of office objections, if any, forthwith which shall be allowed by the Department.
