Heard Ms. Motani, learned Advocate for Petitioners. 2.

Present Misc. Petition is filed by Petitioners for issuance of legal heirship certificate under Section 2 of Bombay Regulation VIII of 1827 in respect of the properties and credits of deceased persons (1) Ami Jatin Shah, (2) Jatin Keshrishand Shah and (3) Ankit Jatin Shah. The names and details of legal heirs of the deceased are stated in paragraph No.6 of the Petition. Purpose for filing the present Petition is stated in paragraph Nos.7, 8 and 9 of the Petition. I have perused the same.

Petitioners are the sole legal heirs of the deceased persons. 4.

In view of the above, there can be no impediment in

159.MPT.731.2025.doc allowing the Petition. Misc. Petition is allowed and disposed of in terms of prayer clause 'a' which reads thus:- "'a'

That a Legal Heirship Certificate Certifying that Mr. Ankur Shah, Son of the deceased no.1 & 2 is the only heir and Legal representatives of the deceased 1 & 2 whereas that a Legal Heirship Certificate Certifying that Mrs. Rikina Ankit Shah, Wife of the deceased no. 3 & Miss Reanna Ankit Shah, daughter of Ankit Shah is the only heir and Legal representatives of the deceased 3 under the provision of Bombay Regulation Act VIII of 1827 and to transfer the Right, title and interest in respect of the aforesaid Immovable property in the name of the petitioners and record / Substitute the name of the petitioners in the place of the deceased in 7/12 Extract as per the appropriate share as mentioned in petition."

Issuance of proclamation stands dispensed with. 6.

Department is directed to issue the legal heirship certificate as directed above within a period of 3 weeks from today positively. 7.

Misc. Petition is allowed and disposed subject to compliance of office objections, if any, forthwith which shall be allowed by the Department.
