Heard Mr. Rane, learned Advocate for Petitioner. 3.

At the outset, Mr. Rane seeks leave of the Court to amend the name of legal heir who is sole Petitioner which inadvertently mentions the name of deceased in paragraph No.4. Necessary amendment is permitted to be carried out in column No.2 of paragraph No.4 of the Petition within a period of one week from today. Reverification stands dispensed with. Such amendment is permitted to be carried out in the original copy retained with Petitioner and he is permitted to file the same in the Department forthwith. Amended copy shall be uploaded by Advocate for Petitioner. Reverification stands dispensed with.

Present Misc. Petition is filed by Petitioner for issuance of legal heirship certificate under Section 2 of Bombay Regulation VIII of 1827 in respect of the properties and credits of deceased E R Lalithambal. The names and details of legal heirs of the deceased are stated in paragraph No.4 of the Petition. Purpose for filing the present Petition is stated in paragraph No.8 of the Petition. I have perused the same.

Petitioner is the sole legal heir of deceased. 6.

In view of the above, there can be no impediment in allowing the Petition. Misc. Petition is allowed and disposed of in terms of prayer clause 'a' which reads thus:- "a.

That Legal Heirship Certificate in the form of Appendix of the Bombay Regulation VIII of 1827 be granted to the Petitioner i.e. ANAND PARAMESWARAN declaring that legal heir of the Deceased Late E.R.LALITHAMBAL and to entitle estate of the deceased which is more particularly mentioned in the Schedule - I herein at Exhibit "D" to the present petition." 7.

Issuance of proclamation stands dispensed with. 8.

Department is directed to issue the legal heirship certificate as directed above within a period of 4 weeks from today positively. 9.

Misc. Petition is allowed and disposed subject to compliance of office objections, if any, forthwith which shall be allowed by the Department.
