By an order dated October 1, 2025, it was recorded that Petitioner No. 4, Mr. Bade and the Developer had agreed to settle all their disputes and differences finally by a payment of Rs.1 lakh and with an undertaking that the monthly rent of Rs.55,935/- until November 2025 with an escalation of 10% for every subsequent eleven months period shall be paid. Such settlement was accepted and it was recorded that the amounts shall be paid within a period of ten days from the date of upload of that order.

Thereafter, the Petition was listed today. After the matter was argued for sometime, both the parties had left it to this Court to firm up a specific amount that may be directed to be paid to Maniar family to settle the disputes and differences with respect to the monetary compensation. The Developer is offered the same terms of Rs. 1 lakh to the Maniar family while the Maniar family had demanded Rs. 10 lakhs including costs of litigation and outstanding rent from July 2023.

Since both parties have agreed to resolve all disputes and differences with respect to the monetary compensation and have left it to this Court to fix an amount, it is hereby directed that all amounts that are outstanding in terms of the Consent Terms dated August 22, 2022 shall be payable which in any case forms part of an executable order dated August 30, 2022. Without prejudice to the same, should the Developer pay a sum of Rs. 1,25,000/- to the Maniar family which amount shall be payable within a period of two weeks from the upload of this order on the website of this Court, the captioned proceedings insofar it relates to the Maniar family shall also stand settled, akin to the manner in which the proceedings in which the Bade family stands settled. The Respondents through their affidavit dated September 27,

2025, are to bring the NOC for parking by December 31, 2025 and procure O.C. by February 28, 2026.
