This Contempt case has been filed alleging willful disobedience of the Order dated 19th September, 2018 passed by this Court in Original Side Writ Petition No.2490 of 2018 wherein certain directions were issued to the Respondent No.4 i.e., the Developer which is the Respondent No.2 in the present Contempt Petition.

It appears that upon receipt of the notice issued in this proceeding, the Respondent No.2 had entered appearance by engaging a Counsel. However, the Counsel for the Respondent No.2 namely Mr. Prakhar Tandon i/b. Mr. Gaurav Patankar although present on 25th March, 2026, did not appear on the next date i.e., 24th April, 2026.

As such, for the ends of justice, this matter was directed to be posted again today i.e., 28th April, 2026 so as to give one more opportunity to the Respondent No.2 as well as the Respondent No.3 to appear in the matter. However, these Respondents are absent today.

Under such circumstances, we are left with no other option but to issue bailable warrant to Mr. Pritesh Danji Savla, the Proprietor of Respondent No.2 and also to Mr. Purandar K. Shetty, the Secretary of Respondent No.3-Society so as to secure their attendance before this Court on the next date. 5.

As such, bailable warrants be issued against both the above Respondents in the manner as indicated above for the sum of Rs.50,000/- each, by making it returnable on 7th May, 2026. Registry to follow due process.
