By this Chamber Order the Applicant seeks permission to serve the citation upon (1) Mrs. Archana Sharad Nigam, daughterin-law of the deceased (2) Shri Amit Sharad Nigam, grandson of the deceased by way of substituted service as per schedule annexed to the Chamber Order.

Perused the schedule. The Applicant applies for publication of citation in two newspapers viz. "Free Press Journal" in English Language and in "Navshakti" in vernacular language i.e. Marathi, widely circulated in Mumbai.

Perused the affidavit in support. The Applicant has stated in the affidavit that, the parents of the deceased and parents of the husband of the deceased predeceased the deceased. It is further stated that, Shri Sharad Varma @ Shri Sharad Nigam son of the deceased and brother of the Applicant / Petitioner died on 17th November 2014 leaving behind his wife Mrs. Archana Sharad Nigam and one son Shri Amit Sharad Nigam, whose whereabouts are not known to the Applicant / Petitioner. It is further stated that, the

Applicant is unaware about the spouse and son of Shri Sharad Varma as the family were not in touch with him post his marriage as he cut of all ties with the Applicant, his mother and remaining members of the family. It is further stated that the Applicant had enquired with everyone, relatives, friends but nobody aware the whereabouts of wife and son of Shri Sharad Varma alias Sharad Nigam. The Applicant, therefore, requested to permit him to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Navshakti" in vernacular language i.e. Marathi, widely circulated in Mumbai.

Heard. Ld. Advocate for the Applicant submits that, the parents of the deceased and parents of the husband of the deceased predeceased the deceased. She further submits that, Shri Sharad Varma @ Shri Sharad Nigam son of the deceased and brother of the Applicant / Petitioner died on 17th November 2014 leaving behind his wife Mrs. Archana Sharad Nigam and one son Shri Amit Sharad Nigam, whose whereabouts are not known to the Applicant / Petitioner. She further submits that, the Applicant is unaware about the spouse and son of Shri Sharad Varma as the family were not in touch with him post his marriage as he cut of all ties with the Applicant, his mother and remaining members of the family. She further submits that, the Applicant had enquired with everyone, relatives, friends but nobody aware the whereabouts of wife and son of Shri Sharad Varma alias Sharad Nigam. She, therefore, prays that, the Chamber Order be allowed.

Perused para 8 of the Petition. For the reasons mentioned in the affidavit in support the Chamber Order is allowed. Applicant to publish the citation in two newspapers viz. "Free Press

Journal" in English Language and in "Navshakti" in vernacular language i.e. Marathi, widely circulated in Mumbai, by way of substituted service of citation upon (1) Mrs. Archana Sharad Nigam, daughter-in-law of the deceased (2) Shri Amit Sharad Nigam, grandson of the deceased within four weeks from the date of uploading this Order. Applicant to file the affidavit of publication once the citation is published within two weeks thereafter. 6.
