By this Chamber Order the Applicant seeks permission to serve the citation upon Shri Himanshu Arun Kothari, one of the legatee of the deceased by way of substituted service as per schedule annexed to the Chamber Order.

Perused the schedule. The Applicant applies for publication of citation in two newspapers viz. "Free Press Journal" in English Language and in "Mid Day" in vernacular language i.e. Gujarati, widely circulated in Mumbai.

Perused the affidavit in support. Heard. Ld. Advocate for the Applicant submits that, Shri Himanshu Arun Kothari is the son Devyani Arun Kothari and legatee of the deceased. The said Shri Himanshu Arun Kothari beneficiaries under the Will of the deceased Gunvantiben Rajnikhantbhai Mehta. He further submits that, the Applicant is not aware whereabouts of the said Shri Himanshu Arun Kothari and the Applicant had made several enquiry within community and mutual acquaintances to find out the address and whereabouts of Shri Himanshu Arun Kothari could not be found.

He, therefore, prays that, Applicant be permitted to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Mid Day" in vernacular language i.e. Gujarati widely circulated in Mumbai and Chamber Order be allowed. 5.

Perused the Petition and Will of the deceased. For the reasons mentioned in the affidavit in support the Chamber Order is allowed. Applicant to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Mid Day" in vernacular language i.e. Gujarati, widely circulated in Mumbai, by way of substituted service of citation upon Shri Himanshu Arun Kothari, one of the legatee of the deceased within four weeks from the date of uploading this Order. Applicant to file the affidavit of publication once the citation is published within two weeks thereafter.
