By this Chamber Order the Applicant seeks permission to serve the citation upon (1) Shri Ramesh Kishinchand Raheja, nephew of the deceased, (2) Smt. Jayeshree Chabbria, niece of the deceased, (3) Smt. Asha Prakash Hansraj, niece of the deceased, (4) Shri Bansi Kishindas Shroff, nephew of the deceased, (5) Smt. Bina Manu Punjabi, niece of the deceased, (6) Smt. Rita Sunil Sabharwal, niece of the deceased and (7) Shri Raj Gokuldas Jaisingh, nephew of the deceased, by way of substituted service as per schedule annexed to the Chamber Order.

Perused the schedule. The Applicant applies for publication of citation in two newspapers viz. "Free Press Journal" in English Language and in "Hindu Sindhi" in vernacular language i.e. Sindhi, widely circulated in Mumbai.

Perused the affidavit in support. Heard. Ld. Advocate for the Applicant submits that, both the deceased died as issueless and their parents have predeceased the deceased. He further submits that, Kishinchand Tarachand Raheja, brother of deceased No. 2 and brother in law of deceased No. 1 predeceased the deceased on 15th

December 2000. The said Kishinchand Tarachand Raheja, died leaving behind him one son viz. Ramesh Kishinchand Raheja and two married daughters viz. Smt. Jayashree Chhabria and Smt. Asha Prakash Hansraj as his surviving legal heirs. He further submits that, Smt. Kalavanti Kishaindas Shroff, the sister of the deceased No. 2 and sister-in-law of Deceased No. 1 as predeceased the deceased on 18th December 2008 leaving behind her only one son viz. Shri Bansi Kishindas Shroff as her surviving legal heirs. Ld. Advocate for the Applicant further submits Smt. Sushila Kanayalal Lulla, other sister of the deceased No. 2 and sister-in-law of the deceased No. 1 predeceased the deceased. The said Smt. Sushila Kanayalal Lulla, died leaving behind her one son viz. Shri Mahesh Kanayalal Lulla herein and Smt.
Maya Kanayalal Lulla, daughter as surviving legal heirs and said Smt. Maya Kanayalal Lulla died on 19th February 2020 as unmarried. He further submits that Smt. Gopi Gokuldas Jaisingh another sister of Deceased No. 2 and sister-in-law of Deceased No. 1 predeceased the deceased leaving behind her two married daughters viz. Smt. Bina Manu Punjabi and Smt. Rita Sunil Sabharwal and one son Shri Raj Gokuldas Jaisingh, as her surviving legal heirs. Ld. Advocate for the Applicant further submits that, the Applicant is not aware whereabouts of the abovenamed legal heirs of the deceased as both the deceased never mentioned about their any other relatives and no one came to see them or visited their residence.
He further submits that, Applicant had tried to locate the whereabouts of the deceased but the Applicant was unable to find out the addresses and whereabouts of the same. He, therefore, prays that, the Applicant, be permitted to publish the citation in two local newspapers viz.

"Hindu Sindhi" in vernacular language i.e. Sindhi, widely circulated in Mumbai and Ld. Advocate for the Applicant, therefore, prays that, the Chamber Order be allowed.

Perused para 9 of the Petition. For the reasons mentioned in the affidavit in support the Chamber Order is allowed. Applicant to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Hindu Sindhi" in vernacular language i.e. Sindhi, widely circulated in Mumbai, by way of substituted service of citation upon abovenamed legal heirs of the deceased within four weeks from the date of uploading this Order. Applicant to file the affidavit of publication once the citation is published within two weeks thereafter.
