By this Chamber Order the Applicant seeks liberty to serve the citation upon Mrs. Pornima Santosh Gawde, wife of the deceased by way of substituted service as per schedule annexed to the Chamber Order.

Perused the schedule. The Applicant applies for publication of citation in two newspapers viz. "Free Press Journal" in English Language and in "Navshakti" in vernacular language i.e. Marathi, widely circulated in Mumbai and District Sindhudurg. 3.

Perused the affidavit in support. The Applicant has stated in the affidavit that, the deceased died as issueless and parents of the deceased predeceased the deceased. It is further stated that, the wife of the deceased left her matrimonial home during the lifetime of the deceased and had filed a Divorce Petition bearing No. A-686 of 2015 and the same was dismissed on 21st July, 2015. It is further stated that, the Petitioner and the bailiff visited for service of the citation upon the wife of the deceased but the same could not be served and the bailiff has filed an affidavit of service dated 17th November 2025. The Applicant, therefore,

requested to permit her to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Navshakti" in vernacular language i.e. Marathi, widely circulated in Mumbai and District Sindhudurg.

Heard. Ld. Advocate for the Applicant submits that, the deceased died as issueless and parents of the deceased predeceased the deceased. He further submits that, the wife of the deceased left her matrimonial home during the lifetime of the deceased and had filed a Divorce Petition bearing No. A-686 of 2015 and the same stands dismissed on 21st July, 2015. He further submits that, the Petitioner and the bailiff visited for service of the citation upon the wife of the deceased but the same could not be served and the bailiff has filed an affidavit of service dated 17th November 2025. He further submits that, the Applicant be permitted to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Navshakti" in vernacular language i.e. Marathi, widely circulated in Mumbai and District Sindhudurg. He, therefore, prays that, the Chamber Order be allowed.

Perused para 8 of the Petition. For the reasons mentioned in the affidavit in support the Chamber Order is allowed. Applicant to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Navshakti" in vernacular language i.e. Marathi, widely circulated in Mumbai and District Sindhudurg, by way of substituted service of citation upon Mrs. Pornima Santosh Gawade, wife of the deceased within four weeks from the date of uploading this Order. Applicant to file the affidavit of publication once the citation is published within two weeks thereafter.
