CHOL/27/2026 IN S(L)/21732/2025 Mr. Dishang Shah i/b. Mr. P.M. Shah, Advocate for Defendant P.C. : The present Chamber Order is taken out by the Applicant for setting aside Order dated 17.09.2025, rejecting captioned Suit under O.S.Rule 986 for non-compliance of office objections.

Heard Ld. Advocate for the Applicant. Perused Affidavit in support of the Chamber Order. It is contended that vide conditional Order dated 17.09.2025, Applicant was directed to remove office objections within four weeks. However, due to sheer oversight and as the concerned Advocate Clerk was on leave, office objections could not be removed within time and the matter got rejected.

Ld. Advocate for the Applicant submits that all office objections are removed on 24.11.2025 and uploaded the same on e-filing portal. Hence, present Chamber Order may be granted as prayed by condoning delay, if any in filing present Chamber Order.

In view of submission made by Ld. Advocate for Applicant and contentions made in Affidavit, I am of the view that the Applicant has made out a case for restoration of captioned Suit. Hence, delay in filing present Chamber Order is condoned and present Chamber Order is granted as prayed and signed separately.
