By this Chamber Order the Applicant seeks permission to serve the citation upon (1) Nilambari Uday Desai, niece of the deceased (2) Atharv Haarish Jadhav, nephew of the deceased, (3) Avinash Vinayak Patil, nephew of the deceased and (4) Anagha Anant Sankpal, niece of the deceased, by way of substituted service as per schedule annexed to the Chamber Order. 2.
Perused the schedule. The Applicant applies for publication of citation in two newspapers viz. "Free Press Journal" in English Language and in "Navshakti" in vernacular language i.e. Marathi, widely circulated in Mumbai.

Perused the affidavit in support. The Applicant has stated in the affidavit that, the husband and parents of the husband of the deceased predeceased the deceased. It is further stated that, the deceased had three brothers-in-laws and two sisters-in-laws. It is further stated that, Manohar Vasudev Kandarkar, brother-in-law of the deceased died on 8th December 2022 leaving behind Nilambari Uday Desai his daughter (niece of the deceased), Atharv Harish Jadhav, Nephew of the deceased, whose whereabouts are not known

to the Applicant. It is further stated that, Sumati Vinayak Patil, sisters-in-laws of the deceased predeceased the deceased leaving behind Avinash Vinayak Patil, son of sisters-in-laws (nephew of the deceased) whose whereabouts are not known to the Applicant. It is further stated that, Satyavati Ramchandra Warang nee Satyavati Vasudev Kandarkar, sisters-in-laws of the deceased expired on 13th October 2025 leaving behind Anagha Anant Sankpal, daughter of Satyavati (niece of the deceased) whose whereabouts are not known to the Applicant. The Applicant, therefore, requested to permit him to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Navshakti" in vernacular language i.e. Marathi, widely circulated in Mumbai.

Heard. Ld. Advocate for the Applicant submits that, the husband and parents of the husband of the deceased predeceased the deceased. He further submits that, the deceased had three brothers-in-laws and two sisters-in-laws. He further submits that, Manohar Vasudev Kandarkar, brother-in-law of the deceased died on 8th December 2022 leaving behind Nilambari Uday Desai his daughter (niece of the deceased), Atharv Harish Jadhav, Nephew of the deceased, whose whereabouts are not known to the Applicant. He further submits that, Sumati Vinayak Patil, sisters-in-laws of the deceased predeceased the deceased leaving behind her son Avinash Vinayak Patil (nephew of the deceased) whose whereabouts are not known to the Applicant. further submits that the Applicant has made diligent search and had made enquiries for the address of the abovenamed legal heirs of the deceased but he could not find. He further submits that, the newspapers widely circulated in Mumbai. He, therefore, prays that, the Chamber Order be allowed.

Perused the Petition. For the reasons mentioned in the affidavit in support the Chamber Order is allowed. Applicant to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Navshakti" in vernacular language i.e. Marathi, widely circulated in Mumbai, by way of substituted service of citation upon (1) Nilambari Uday Desai, niece of the deceased (2) Atharv Haarish Jadhav, nephew of the deceased, (3) Avinash Vinayak Patil, nephew of the deceased and (4) Anagha Anant Sankpal, niece of the deceased, within four weeks from the date of uploading this Order. Applicant to file the affidavit of publication once the citation is published within two weeks thereafter. 6.
