By this Chamber Order has been taken out by the Applicant for substituted service of Notice upon M/s. R.K. Textiles Respondent No. 1, Ms. Rehana Kapadia, Respondent No. 2, Mrs. Narseen Ameen Kapadia, Respondent No. 3, Mrs. Mehjabeen Kapadia, Respondent No. 4, Shri Ameen Jaffer Kapadia, Respondent No. 5A and Shri Ayaz Jaffer Kapadia, Respondent No. 5B as per schedule annexed to the Chamber Order.

Perused the affidavit in support. Heard. Ld. Advocate for the Applicant submits that, the Notice sent for the service upon Respondent No. 1 has been returned by the postal authority with remark "No such persons at the address", Notice sent for the service upon Respondent 3 has been returned by the postal authority with remark "left as building demolished", Notice sent for the service upon Respondent Nos. 2, 4, 5A and 5B have been returned by the postal authority with remark "left". She further submits that, the Applicant may be permitted to serve the Notice by way of substituted service such as affixing a copy of the Notice and Interim Application at the conspicuous part of the last known address of the

abovenamed Respondents and by affixing on the notice board of this Hon'ble High Court as well as by publishing the Notice in two newspapers viz. "Free Press Journal" in English language and in "Nav Shaki" vernacular language i.e. Marathi widely circulated in Mumbai.

For the reasons mentioned in the affidavit in support the Chamber Order is allowed and the same is signed separately. Applicant is directed to publish the Notice within three weeks from the date of uploading this Order and file affidavit of publication within a week thereafter once the publication is done. 20.01.2026 Addl.
