Heard Mr. Wani, learned Advocate for Applicant / Petitioner. 2.

Present Chamber Order is filed for restoration of a dismissed Petition. Petition is filed seeking Letters of Administration in respect of property and credits of the deceased. Matter was before the learned Prothonotary and Senior Master and after much delay by a conditional order dated 28.03.2024 it was directed that if office objections remain to be removed, the Petition would stand dismissed for non-compliance automatically. The said order dated 28.03.2024 is appended at page No.9.

What is intriguing is the reason given for the delay. It is stated in the Application that the Affidavit in support of Chamber

Order that Petitioner is working with Air India as Air Hostess and due to her job profile she has to fly out of the country and hence she could not contact the Advocate. The contrary reason also appear in the same Affidavit which states that the Advocate did not attend the matter due to his personal difficulty as he was not keeping well. These reasons are not even substantiated. There is a delay of 290 days. 4.

In the interest of justice and considering the fact that the Petitioner is a lady, I am inclined to accept the submission made by Mr. Wani for condoning the delay, but the same is subject to payment of costs of Rs.5,000/- to the High Court Employees' Medical Welfare Fund at Mumbai in its Account No.000120110001337 in the Bank of India, Mumbai (Main Branch) [IFSC Code:- BKID0000001]. The cost of Rs.5,000/- shall be paid to the above Medical Welfare Fund and the receipt shall be placed before the Department subject to which this order shall come into force.

If the aforesaid order is complied with, the order dated 28.03.2024 stands quashed and set aside. Delay of 290 days in filing the Chamber Order stands condoned.

Testamentary Petition (L) No.22256 of 2022 is restored to the record and file of the Court subject to the aforesaid compliance.

Chamber Order No.54 of 2026 is allowed and disposed in the above terms.
