The present Chamber Order is taken out by the applicant for setting aside Order dated 20.03.2024 r/w. Order dated 30.09.2024, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.

Ld. Advocate for the applicant submits that respondents were served with the Chamber Order as per Affidavit of Service filed on 24.04.2025.

Heard ld. Advocate for the applicant. Perused Affidavit in Support, contents of which are self-explanatory. It is contended that office objections raised earlier, were complied with within given period, however, further objection was raised with regard to clause in Affidavit for declaration, which remained to be complied with. Further, it is contended that for the same reason delay of 74 days caused in filing present Chamber Order, which may be condoned and captioned Petition may be restored to file.

Ld. Advocate for respondents submitted for passing suitable orders.

Considering reasons mentioned in the Affidavit by the applicant, I am of the view that substantial justice cannot be denied on technical ground. The applicant should get one opportunity to pursue with the captioned Petition. No prejudice would cause to the respondents since they can contest the petition

CHOL/89/2025 in WPL/30038/2023 ) ) ) ) ) ) ) ) ) ) ) ) ) on its own merits once the petition is restored to file. Hence, in the interest of justice, delay of 74 days caused in filing present Chamber Order, is condoned and present Chamber Order is granted as prayed and signed separately.

The petitioner to remove office objections on the Petition and get the same registered and/or numbered within four weeks from the date of uploading of order, failing Petition to stand rejected for non-compliance of office objections under O.S.Rule 986.
