1. This Chamber Order is taken out by Mr.

Ajay R. Singh, Applicant/Advocate for Appellant seeking discharge on behalf of Appellant, Mukand Global Finance Ltd. in ITXA/1190/2008.

2. Applicant has filed Affidavit of service dated 14.02.2025. Inspite of service, no one is present on behalf of Appellant.

3. Perused Affidavit in support dated 30.01.2025. Para - 2 and 3 are relevant which are reproduced hereunder;

2. I say that the above matter was listed for directions board before the Hon'ble Bombay High Court Hon'ble Justice G. S. Kulkarni and Hon'ble Justice Somasekhar Sundaresan on 24/7/2024. I say that I have made repeated attempts to ascertain the status of the Appellant Company. Several email communications have been sent to the Appellant's registered email IDs, and that of the Instructing Chartered Accountant requesting an update on the matter; however, no response has been received to date. Exhibit -'A' to 'D' are the copies of the email dated 22/7/2024, 14/8/2024, 04/10/2024 and 26/12/2024 sent to the Appellant.

3. I say that by a notice dated 10th January 2025, sent via Speed Post, the Appellant was

informed that in the absence of instructions, it would not be possible to continue to represent the Appellant. Exhibit-'E' and 'F' is a Copy of (i) the Letter along with the Postal Acknowledgment and ii) the track report generated from India Post website."

4. I am satisfied that the Ld. Advocate has substantially complied with the procedure for obtaining discharge under High Court, Original Side Rules read with the provisions and Rules framed under the Advocates Act.

In view of above, Chamber Order is allowed and signed separately. Advocate, Mr. Ajay Singh has been discharged on behalf of the Appellant in ITXA/1190/2008.

Office to delete the name of Advocate Mr.

Ajay Singh as Advocate for the Appellant in ITXA/1190/2008. Mr. Ajay Singh to communicate this Order to the Appellant and thereafter, Appellant to engage another Advocate, if it so desire.
