By this Chamber Order the Applicant seeks liberty to serve the citation upon (1) Manisha Sawarkar, Niece of the deceased, (2) Geeta Apte, Niece of the deceased, (3) Tai Attya, Sister of the deceased, (4) Bai Attya, Sister of the deceased and (5) Chintamani Keni, Brother of the deceased, by way of substituted service as per schedule annexed to the Chamber Order. 2.

Perused the schedule. The Applicant applies for publication of citation in three newspapers viz. "Free Press Journal" in English Language, in "Navshakti" in vernacular language i.e. Marathi, and "Mumbai Samachar" in vernacular language i.e. Gujarati, widely circulated in Mumbai.

Perused the affidavit in support. The Applicant has stated in the affidavit that, the deceased died as issueless and the deceased did not have any other niece of kin or any other legal heirs. It is further stated that, the Petitioner is not aware their present address and despite making diligent efforts and inquiries and attempts to trace them through available sources, the Applicant has not been able to ascertain their correct and present address.

The Applicant, therefore, requested to permit him to publish the citation in three newspapers viz. "Free Press Journal" in English Language, in "Navshakti" in vernacular language i.e. Marathi, and "Mumbai Samachar" in vernacular language i.e. Gujarati, widely circulated in Mumbai.

Heard. Ld. Advocate for the Applicant submits that, the deceased died as issueless and the deceased did not have any other niece of kin or any other legal heirs. He further submits that, the Petitioner is not aware their present address and despite making diligent efforts and inquiries and attempts to trace them through available sources, the Applicant has not been able to ascertain their correct and present address. He further submits that, the Applicant be permitted to publish the citation in three newspapers viz. "Free Press Journal" in English Language, in "Navshakti" in vernacular language i.e. Marathi, and "Mumbai Samachar" in vernacular language i.e. Gujarati, widely circulated in Mumbai. He, therefore, prays that, the Chamber Order be allowed.

Perused para 11 of the Petition. For the reasons mentioned in the affidavit in support the Chamber Order is allowed. Applicant to publish the citation in three newspapers viz. "Free Press Journal" in English Language, in "Navshakti" in vernacular language i.e. Marathi, and "Mumbai Samachar" in vernacular language i.e. Gujarati, widely circulated in Mumbai, by way of substituted service of citation upon (1) Manisha Sawarkar, Niece of the deceased, (2) Geeta Apte, Niece of the deceased, (3) Tai Attya, Sister of the deceased, (4) Bai Attya, Sister of the deceased and (5) Chintamani Keni, Brother of the deceased, within four weeks from the date of

uploading this Order. Applicant to file the affidavit of publication once the citation is published within two weeks thereafter. 6.
