The present Chamber Order is e-filed by the applicant for setting aside Order dated 14.01.2025, rejecting captioned Caveat under O.S.Rule 986 for non-compliance of office objections.

It appears that on last occasion ld. Advocate for the org. petitioner had made a statement that they have received Chamber Order, however, today, none appeared for and on behalf of the org. petitioner.

Heard ld. Advocate for the applicant. Perused Affidavit in Support, in which it is contended that Advocate handling the matter, left the Firm without knowledge of the Firm due to which office objections could not be complied with within given period. It is further contended that the applicant has a good case on merits and grave prejudice would be caused if captioned Caveat is not restored to file.

Contention raised in the Affidavit, remains uncontested for want of resistance from the org. petitioner. Therefore, I do not hesitate to rely on the same for the purpose of restoration of captioned Caveat with a view that the applicant would get one opportunity to pursue with the captioned Caveat. Hence, in the interest of justice, present Chamber Order is granted as prayed.
