The present Chamber Order is e-filed by the applicant for setting aside Order dated 10.03.2025, rejecting captioned Caveat under O.S.Rule 986 for non-compliance of office objections.

Heard ld. Advocate for the applicant. Perused Affidavit in Support, contents of which are self-explanatory. It is specifically contended that the applicant came to know about Conditional Order on 21.04.2025 due to which office objections could not be removed within given time. Ld. Advocate for the applicant submits that now she will pursue with captioned Caveat diligently if she gets one opportunity and prays for restoration of captioned Caveat.

Ld. Advocate for the petitioner objected present Chamber Order and prays for rejection of the same.

Upon hearing rival submissions of both ld. Advocates, I am of the view that the applicant should get one opportunity to pursue with the matter. No prejudice would cause to the petitioner since the petitioner can contest matter on its own merits. Furthermore, substantial justice cannot be denied on technical grounds. However, it would be just and proper to impose certain cost on the applicant so that the applicant would be more diligent in pursuing with matter. Hence, in the interest of justice, the present Chamber Order

CHOL/128/2026 in CTSL/27242/2024 ) ) ) ) ) ) ) ) ) ) ) is granted as prayed subject to payment of cost of Rs. 2,500/- to the petitioner.

Upon payment of cost, captioned Caveat be restored to file and the caveator to remove office objection of Caveat and get the same registered and/or numbered by filing /uploading compliance praecipe within two weeks from the date of payment of cost, failing Caveat to stand rejected for non-compliance of office objections under O.S.Rule 986.
