The present Chamber Order is e-filed by the applicant for setting aside Order dated 22.07.2025, rejecting captioned Caveat under O.S.Rule 986 for non-compliance of office objections.
Heard ld. Advocate for the applicant. Perused Affidavit in Support, contents of which are self-explanatory. It is contended that due to efflux of time, the Advocate on record was not in a position to comply remaining office objections. It is further contended that there is delay of 15 days in filing present Chamber Order, which was not intentional. Therefore, it is prayed that captioned Caveat may be restored to file.
Ld. Advocate for petitioner submitted for passing suitable order.
Considering grounds raised in Affidavit, I am of the view that the applicant should get one opportunity to pursue with captioned Caveat.
No prejudice would cause to the respondent since respondent can contest matter on its own merits. Hence, in the interest of justice, delay of 15 days caused in filing present Chamber Order is condonded and the present Chamber Order is granted as prayed.
The caveator to remove office objection of Caveat and get the same registered and/or numbered by filing compliance praecipe within two weeks from the date of uploading
