CHOL/131/2026 IN MPT(L)/8186/2024 P.C. : The present Chamber Order is e-filed by the Applicant for setting aside Order dated 05.08.2025, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.

Heard Ld. Advocate for the Applicant. Perused Affidavit in Support to the Chamber Order. It is contended therein that vide conditional order dated 05.08.2025, eight weeks time was granted to remove office objections. During that period, the Applicant was trying to trace a record bearing identity of the deceased which was required to be furnished to the Registry to remove office objections. However, he could trace the same by the end of the prescribed period. It is further stated that all office objections were removed and the compliance praecipe was uploaded on e-filing portal on 07.10.2025 which was approved on 08.10.2025. However, the matter had already stood rejected on 30.09.2025 by virtue of self operating Order dated 05.08.2025.

Ld. Advocate for the Applicant submits that he will pursue with the caption Petition diligently, and prays for restoration of the same by condoning delay of 39 days.

Reasons mentioned in Affidavit appear to be genuine. So also, the Applicant had made attempts to remove office objections and substantial justice cannot be denied on technical grounds. Therefore, delay of 39 days caused in filing present Chamber Order is condoned and present Chamber Order is granted as prayed.
