By this Chamber Order, the Applicant seeks permission to serve the citation upon Neha Ashok Singh, grand-daughter of the deceased and daughter of late Ashok Singh, son of the deceased, by way of substituted service as per schedule annexed to the Chamber Order.

Perused the schedule. The Applicant applies for publication of citation in two newspapers viz. "Free Press Journal" in English Language and in "Navbharat" in vernacular language i.e. Hindi, widely circulated in Mumbai.

Perused the affidavit in support and additional affidavit. The Applicant has stated in the additional affidavit that, late Ashok Singh, son of the deceased had got divorce with his wife. It is further stated that, the whereabouts of Neha Singh, granddaughter of the deceased is not known to the Applicant. The Applicant, therefore, prayed to permit her to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Navbharat" in vernacular language i.e. Hindi, widely circulated in Mumbai.

Heard. Ld. Advocate for the Applicant submits that, Ashok Singh, son of the deceased had got divorce with his wife by Divorce Decree dated 6th June, 1996 during his lifetime. She further submits that, Shri Ashok Kumar Singh had a daughter viz. Neha Ashok Singh and she had been in the custody of her mother since date of divorce. She further submits that, Applicant is not aware of the whereabouts of Neha Ashok Singh. She further submits that, Shri Ashok Kumar Singh has also expired on 20th November 1999. She, therefore, prays that, the Chamber Order be allowed.

Perused para 9 of the Petition. For the reasons mentioned in the affidavit in support the Chamber Order is allowed. Applicant to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Navbharat" in vernacular language i.e. Hindi, widely circulated in Mumbai, by way of substituted service of citation upon Neha Ashok Singh, grand-daughter of the deceased and daughter of late Ashok SIngh within four weeks from the date of uploading this Order. Applicant to file the affidavit of publication once the citation is published within two weeks thereafter.
