Ms. Manisha Gawde, AGP for Respondent No. 3 P.C. : The present Chamber Order is taken out by the Applicant for setting aside Order dated 21.03.2024, 12.04.2024 read with Order dated 30.09.2025 rejecting captioned Writ Petition under O.S.Rule 986 for non-compliance of office objections.

Ld. Advocate for Applicant tendered Affidavit of Service. The same is taken on record.

Heard Ld. Advocate for the Applicant. Perused Affidavit in Support of the Chamber Order. It is contended therein that in view of order dated 21.03.2024, three weeks time was granted to remove office objections in captioned Petition. However, when the matter appeared before the Hon'ble Single Bench, it was directed to be placed before the Hon'ble Division Bench and in the meantime, Petition got rejected. Further, vide Order dated 12.04.2024, time was grated to remove office objections till 26.04.2024 but the translation of certain documents took time and matter got rejected. Hence, the Advocate for Applicant took out Chamber Order (L) No. 418 of 2025 which came to be allowed and by Order dated 30.09.2025 when two weeks time was granted to remove office objections after paying cost of Rs. 5,000/-. support that as the Petitioner was travelling during that period, cost could not be deposited and in the meantime, matter got rejected.

) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) Heard Ld. Advocate for the Applicant. Ld. Advocate for the Applicant submits that delay in removing office objections was neither deliberate nor intentional. Hence, present Chamber Order may be granted.

Reasons mentioned in the Affidavit in Support appears to be bonafide and substantial justice cannot be denied on technical grounds. Hence, present Chamber Order is granted as prayed by condoning delay of 184 days caused in filing Chamber Order, upon payment of cost of Rs. 2,500/- to 'The High Court Employees Medical Welfare Fund at Mumbai' - Bank of India Mumbai (Main) Branch, Account No. 000120110001337, IFSC Code : BKID0000001, to be paid within one week.

The Petitioner to remove office objections on the Petition and get the same registered and/or numbered within two weeks from the date of payment of cost, failing Petition to stand rejected for non-compliance of office objections under O.S.Rule 986.
