Mr. Shivaji Yadav, Advocate for Applicant P.C. : The present Chamber Order is e-filed for restoration of the captioned Petition, which was rejected vide Order dated 28.03.2024 for non- compliance of office objections under O.S. Rule 986.

) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) Perused e-filed Affidavit in support of Chamber Order. It is stated therein that the present Testamentary Petition is filed for obtaining Probate of Will of the deceased, under Indian Succession Act. It is further stated that due to personal difficulty, one of the office objections with regard to payment of cost of Rs. 75,000/- could not be complied within time and the matter got rejected for non-compliance of office objections. It is further stated that as one of the Petitioners had gone to native place for several months, Chamber Order could not be filed within time and there is delay of 281 days in filing present Chamber Order.

Ld. Advocate for the applicant submits that she will pursue with the captioned Petition diligently if it is restored to file.

Considering grounds raised in the Affidavit and submission made by Ld. Advocate for Applicant, I am of the view that Applicant has made out his case for restoration of the present Petition. Hence, present Chamber Order is granted as prayed.

The petitioner to remove office objections on the Petition and get the same registered and/or numbered within four weeks from the date of uploading of order, failing Petition to stand rejected for non-compliance of office objections under O.S.Rule 986.
