The present Chamber Order is e-filed by the applicant for setting aside Order dated 04.03.2024 r/w. Order dated 11.02.2025, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.

Ld. Advocate for the applicant submits that respondents were served with the Chamber Order as per Affidavit of Service dated 12.06.2025, filed on record. Despite service, none appeared for the respondents.

Heard Ld. Advocate for the applicant. Perused Affidavit in Support, in which it is contended that original copies of exhibits were provided to the Counsel, however, said copies were faded due to their age. Further, it is contended that said documents were retyped, but since same were bulky in nature, typing work could not be completed within stipulated period. It is, therefore, prayed that captioned Petition may be restored to file.

On going through the grounds raised in Affidavit, it appears that the applicant had taken efforts to comply office objections, however, for the reasons stated, as aforesaid, objections could not be complied with within given time. Hence, I am of the view that the applicant should get one opportunity to pursue with the captioned Petition. Moreover, none appeared for the respondents despite service. No prejudice would cause to the respondents since they can contest the Petition on merits once it is restored to file. In view thereof, the present Chamber Order is granted as prayed.
