37. CHOL/256/2025 in CHOL/387/2024 IN WPL/854/2023 P.C. : The present matter is placed on board in view of praecipe dated 04.07.2025 filed by Ld. Advocate for Applicant which is self explanatory.

Advocate for the Applicant submits that earlier Chamber Order No. 387 of 2024 was taken out to restore the captioned Petition which came to dismissed by Order dated 24.02.2025 for nonprosecution. Thereafter, Chamber Order No. 256 of 2025 was taken out to restore the earlier Chamber Order No. 387 of 2024 and the same came to be allowed vide Order dated 17.06.2025. However, third line of Para No. 1, sixth line of Para No. 3, third line of Para No. 4 and last para are required to be modified.

In view of submission made by Ld. Advocate for Applicant, third line of Para No. 1, sixth line of Para No. 3, third line of Para No. 4 and last para are required to be modified.

1st Para of Order dated 17.06.2025 may be read as : "The present Chamber Order is e-filed by the Applicant for setting aside Order dated 24.02.2025 passed in Chamber Order No. 387 of 2024 which was dismissed for non-prosecution."

Last sentence of third Para may be read as :

" It is therefore prayed that Order dated 24.02.2025 passed in Chamber Order No. 387 of 2024 be set aside and Chamber Order No. 387 of 2024 may be .... 2

Prothonotary and Senior Master Date : 10th July, 2025 .... Continued CHOL/256/2025 in CHOL/387/2024 : 2 :

in WPL/854/2023 ) allowed to restore to file."

) ) 4th Para, third line may be read as :

"Therefore, I am of the view that the Applicant should get one opportunity to pursue with the captioned Chamber Order. No prejudice would cause to the Respondent if captioned Chamber Order is restored to file as they can contest the Chamber Order on merit."

) ) ) ) ) ) ) Last Paragraph may be read as :

"The Petitioner to comply directions issued vide Minutes of Order dated 22.01.2025 in Chamber Order No. 387 of 2024 within four weeks from the date of uploading of the Order; failing Chamber Order No. 387 of 2024 will be dismissed for nonprosecution." ) ) ) ) ) ) ) Rest of the Order stands as it is.
