The present Chamber Order is filed by the applicant for setting aside Order dated 29.04.2025, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.

Ld. Advocate for the applicant submits that respondents were served with the Chamber Order as per Affidavit of Service filed on record. Despite service, none appeared for respondents, save and except respondent no.

Heard ld. Advocate for the applicant. Perused Affidavit in Support to the Chamber Order filed by the applicant, contents of which are self-explanatory.

It is contended that inadvertently, clerk of Advocate failed to remove office objections within stipulated period. Ld. Advocate for the applicant submits that now she will pursue captioned Petition diligently if it is restored to file and prays for restoration of the same.

Ld. Advocate for respondent no. 3 submits for passing suitable order in the matter.

Contentions raised in the Affidavit appear to be bonafide and substantial justice cannot be denied on technical grounds. However, it would be just and proper to impose cost on the applicant so that the applicant would be more diligent in pursuing captioned Petition once it is restored to file.
