1. By the present Chamber Order, the Applicant / Plaintiff seeks deletion of the name of Defendant No.5 viz. Prakash Kumbandas Tejani from the cause title and bring on record his legal heirs Hema Prakash Tejani, Dimpal Prakash Tejani and Vandana Dinesh Kushte.

2. The Chamber Order has been served upon the proposed Defendant No.5 (A) to Defendant No.5 (C). The Affidavit of Service dated 29th July, 2025 is on record.

3. Heard, the Ld. Advocate for the Applicant submits that the Defendant No.5 expired on 29th April, 2025 and the legal heirs of the Defendant No.5 are to be brought on record. She further submits that the Applicant / Plaintiff be permitted to amend the Plaint and other pleadings as per the Schedule annexed to the Chamber Order and also to carry out consequential amendments.

4. Perused the Affidavit in Support dated 24th June, 2025. Perused the Death Certificate of Defendant No.5, who expired on 29th April, 2025. For the reasons mentioned in the Affidavit in Support the Chamber ..2/-
