The present Chamber Order is e-filed by the applicant for setting aside Order dated 14.02.2025, rejecting captioned Petition under O.S.Rule 986 for non-removal of office objections.

Heard ld. Advocate for the applicant. Perused Affidavit in Support, contents of which are self-explanatory. It is contended that original Will was handed over to clerk for filing it in the matter, however, it was misplaced and evenafter diligent search, said Will was not found. Therefore, the applicant has obtained certified copy of said Will from Joint Sub Registrar Office, Mumbai on 13.03.2025, however, in the meantime, time granted for removing office objection got expired. Relying on the contentions raised in Affidavit, ld. Advocate prays for restoration of captioned Petition.

Grounds mentioned on oath, appear to be genuine and substantial justice cannot be denied on technical ground. Hence, in the interest of justice, the present Chamber Order is granted as prayed.

The petitioner to remove office objections on the Petition and get the same registered and/or numbered within six weeks from the date of uploading of order, failing Petition to stand rejected for non-compliance of office objections under O.S.Rule 986.
