The present Chamber Order is e-filed by the applicant for setting aside Order dated 28.04.2025, rejecting captioned Caveat under O.S.Rule 986 for non-compliance of office objections.
Ld. Advocate for the applicant submits that respondent/petitioner was served with the Chamber Order as per Affidavit of Service filed on record. Despite service, none appeared for respondent/petitioner.
Heard ld. Advocate for the applicant. Perused Affidavit in Support to the Chamber Order filed by the applicant, contents of which are self-explanatory.
It is contended that inadvertently, clerk of Advocate failed to remove office objections within stipulated period. Ld. Advocate for the applicant submits that now she will pursue captioned Caveat diligently if it is restored to file and prays for restoration of the same.
Contentions raised in the Affidavit remain uncontested for want of resistance on the part of respondent. Hence, I rely on the said contentions for the purpose of restoration of captioned Caveat. Hence, in the interest of justice, the present Chamber Order is granted as prayed.
The caveator to remove office objections on the Caveat and get the same registered and/or numbered within six weeks from the date of uploading of order, failing Caveat to stand rejected for non-compliance of office objections under O.S.Rule 986 without reference to this Authority.
