1. The present Chamber Order is taken out to serve the Citation upon (1) Shyam A. Shinde (Son of the deceased),

(2) Dilip A. Shinde (Son of the deceased), (3) Suresh A. Shinde (Son of the deceased) and (4) Suhas A. Shinde (Son of the deceased) by way of substituted service as per the Schedule annexed to the Chamber Order.

Perused Schedule. The Petitioner is seeking permission to publish the Citation in two newspapers i.e. in "India Post Newpaper" in English language at Fremont, California State, U.S.A, by way of substituted service upon

(1) Shyam A. Shinde (Son of the deceased), (2) Dilip A. Shinde (Son of the deceased) and in "News India Times" in English language at Terre Haute, Indiana State, U.S.A., by way of substituted service upon (3) Suresh A. Shinde (Son of the deceased) and (4) Suhas A. Shinde (Son of the deceased).

Perused the Affidavit dated 30th June, 2025 annexed to Chamber Order. It is stated in the said Affidavit that the since more than two decades, the Applicant is not in contact with Legal heirs viz. (1) Shyam A. Shinde, (2) Dilip A. Shinde, (7) Suresh A. Shinde and (8) Suhas A. Shinde, who are at present residing in USA. It is further stated that ..2/-

the Applicant is not aware of their present residential address and he had contacted his relatives and friends and made enquiry about the whereabouts of above named Legal Heirs but could not find. It is further stated that even after due and diligent efforts he was unable to trace the whereabouts/ present addresses/ communication details of the aforesaid legal heirs. The Applicant therefore requested to permit him to publish the Citation upon (1) Shyam A. Shinde (Son of the deceased), (2) Dilip A. Shinde (Son of the deceased), (3) Suresh A. Shinde (Son of the deceased) and (4) Suhas A. Shinde (Son of the deceased) by way of substituted service by publishing in two newspapers i.e. in "India Post Newpaper" in English language at Fremont, California State, U.S.A, by way of substituted service upon

(1) Shyam A. Shinde (Son of the deceased), (2) Dilip A. Shinde (Son of the deceased) and in "News India Times" in English language at Terre Haute, Indiana State, U.S.A., by way of substituted service upon (3) Suresh A. Shinde (Son of the deceased) and (4) Suhas A. Shinde (Son of the deceased).

Perused Para-11 of the Petition, it is mentioned and confirmed that the averment made in the Affidavit in respect of the addresses not known to the Petitioner. 5.

Heard. The Ld. Advocate for the Applicant submits that the said Affidavit that the since more than two decades, the Applicant is not in contact with Legal heirs viz. (1) Shyam A. Shinde, (2) Dilip A. Shinde, (7) Suresh A. Shinde and (8) Suhas A. Shinde, who are at present residing in USA. She further submits that the Applicant is not aware of their present residential address and he had contacted his relatives and friends and made enquiry about the whereabouts of above named Legal Heirs but could not find. addresses/ communication details of the aforesaid legal heirs. She therefore prays that the Chamber Order be allowed.

For the reasons stated in Affidavit dated 30th June, 2025 annexed to the Chamber order and averment made in Para-11 of the Petition, the Chamber Order is allowed. The Applicant is directed to publish the Citation in two newspapers i.e. in "India Post Newpaper" in English language at Fremont, California State, U.S.A, by way of substituted service upon (1) Shyam A. Shinde (Son of the deceased), (2) Dilip A. Shinde (Son of the deceased) and in "News India Times" in English language at Terre Haute, Indiana State, U.S.A., by way of substituted service upon

(3) Suresh A. Shinde (Son of the deceased) and (4) Suhas A. Shinde (Son of the deceased), within six weeks from the date of uploading the order. Office is directed to issue fresh Citation, if required.

7. Applicant to file Affidavit annexing therewith the newspapers within two weeks once, the publication is done. Addl. Registrar (O.S.) / Addl. Prothonotary and Senior Master 17.07.2025
