P. C. :

1. The present Chamber Order is taken out to serve the Citation upon Ganpat Karpe, husband of the deceased by way of substituted service as per the Schedule annexed to the Chamber Order.

Perused Schedule. The Petitioner is seeking permission to publish the Citation in two newspapers viz. "Free Press Journal" in English Language and in "Navshakti" newspaper in vernacular language (Marathi). 3.

Perused the Affidavit in support dated 12.07.2025. It is stated in the Affidavit in support that the deceased died as issueless. The Applicant has stated that the Husband of the deceased i.e., Sundarabai Kisan Khond alias Sunderbai Kisan Khond alias Sunderbai K. Khond alias Khond Sundarabai Kisan alias Sunderabai K Khond alias Sundrabai Kisan Khond deserted the deceased just in 6 months from her marriage in 1958 and is not traceable since then. It is further stated that the said husband of the deceased abovenamed never visited to see deceased during her lifetime nor the deceased had given any details about him or his whereabouts. The Applicant has further stated that he had tried to search the whereabouts of the Legal heir of the deceased, from family friends, relatives but despite due and diligent, search he could not hear from anyone. The Applicant, therefore, requested to permit him to publish the Citation upon the abovenamed legal heir by way of substituted service by publishing in two newspapers viz. "Free Press Journal" in English Language and in "Navshakti"

Perused Para-8 of the Petition, it is mentioned and confirmed that the averment made in the Affidavit in respect of the whereabout is not known to the Petitioner. 5.

Heard. The Ld. Advocate for the Applicant submits that the deceased died as issueless and that the Husband of the deceased i.e., Sundarabai Kisan Khond alias Sunderbai Kisan Khond alias Sunderbai K. Khond alias Khond Sundarabai Kisan alias Sunderabai K Khond alias Sundrabai Kisan Khond deserted the deceased just in 6 months from her marriage in 1958 and is not traceable since then. She further submits that the said husband of the deceased abovenamed never visited to see deceased during her lifetime nor the deceased had given any details about him or his whereabouts the applicant had tried to search the whereabouts of the Legal heir of the deceased, from family friends, relatives but despite due and diligent, search he could not hear from anyone. She, therefore, prays that the Chamber Order be allowed.

For the reasons stated in Affidavit in support annexed to the Chamber order and averment made in Para - 8 of the Petition, the present Chamber order is granted. Publication of Citation to be done in two newspapers viz.

(1) "Free Press Journal" in English and (2) "in "Navshakti" newspaper in vernacular language (Marathi), within four weeks from the date of uploading the order. Office is directed to issue fresh Citation, if required.

7. Applicant to file Affidavit annexing therewith the newspapers within two weeks once, the publication is done.
