The present Chamber Order is taken out by the applicant for setting aside Order dated 11.03.2025, rejecting captioned Petition under O.S.Rule 986 for non-removal of office objections.

Heard ld. Advocate for the applicant. Perused Affidavit in Support, contents of which are self-explanatory. It is contended that office objections were removed and compliance letter was also given. However, it is also contended that too many pages are to be typed which caused delay. Ld. Advocate for the applicant submits that now he will pursue captioned Petition diligently if it is restored to file and therefore, prays for restoration of captioned Petition by condoning delay of 50 days caused in filing present Chamber Order, which was unintentional.

Ld. Advocate for respondent nos. 1 to 5 objected the present Chamber Order and submitted for passing suitable orders.

Considering grounds mentioned on oath, I am of the view that the applicant had made an attempts to remove office objections.

Therefore, substantial justice cannot be denied on technical grounds. The respondents would get opportunity to contest the Petition on its own merits if it is restored to file. However, it would be just and proper to impose some cost on the applicant so that the applicant would be more diligent in pursuing captioned Petition. Hence, in the interest of justice,

The petitioner to remove office objections on the Petition and get the same registered and/or numbered within two weeks from the date of payment of cost, failing Petition to stand rejected for non-compliance of office objections under O.S.Rule 986.
