21. CHOL/414/2025 IN Ms. Simran Raut i/b. Vrushali, Advocate for Respondent No. 1 MPT(L)/17931/2023 Mr. Suryakant Adhate, DM (Legal), MTNL, Representative of Respondent No. 2 present in person P.C. : The present Chamber Order is taken out by the Applicant for setting aside Order dated 09.05.2025, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.

Today, Ld. Advocate for Respondent No. 1 and Representative of Respondent No. 2 i.e. Mr. Suryakant Adhate, DM (Legal) are present.

Heard Ld. Advocate for the Applicant. Perused Affidavit in Support to the Chamber Order. It is contended therein that the Advocate or Clerk could not attend the matter on 09.05.2025 when the mater was listed for rejection and further, due to summer vacation, office objections could not be removed. It is further contended that due to ill health of Petitioner No. 1, Chamber Order could not be filed within time and there is delay of 37 days. Ld. Advocate for the Applicant submits that he will pursue with the captioned Petition diligently if it is restored to file, hence, present Chamber Order be allowed by condoning delay of 37 days.

Considering reasons mentioned as above and submission made by Ld. Advocate for Applicant, in my opinion, one opportunity is required to be given to the Applicant to pursue with the captioned Petition. In view thereof, present Chamber Order is granted as prayed.
