CHOL/420/2025 IN CTS(L)/35331/2024 P.C. : The present Chamber Order is e-filed by the Applicant for restoration of the Caveat and setting aside Order dated 26.02.2025, rejecting captioned Petition under O.S.Rule 986 for noncompliance of office objections. Affidavit of Service showing service of Chamber Order upon other side is already e-filed.
Heard Ld. Advocate for the Applicant. Perused Affidavit in Support to the Chamber Order. It is contended that the Applicant was in process of removing office objections on Caveat, while further office objections were raised which he could not remove within time and Caveat got rejected. It is further stated that there is delay of 48 days in taking out present Chamber Order.
Ld. Advocate for the Applicant submits that he will pursue with the caption Caveat diligently, and prays for restoration of the same by condoning delay.
Considering reasons, as above, it transpires that the Applicant had made an attempts to remove office objections, and he is in process of removing office objections. Therefore, in my opinion, one opportunity is required to be given to the Applicant to pursue with the captioned Caveat. Therefore, delay of 48 days caused in filing present Chamber Order is condoned and present Chamber Order is granted as prayed.
