34. CHOL/435/2025 IN WP(L)/13267/2023 P.C. : The present Chamber Order is taken out by the Applicant for setting aside Order dated 25.03.2025, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.

Heard Ld. Advocate for the Applicant. Perused Affidavit in Support to the Chamber Order. It is contended that most of the office objections have been complied and one of the office objections with regard to submitting a copy of verified Power of Attorney is remaining to be complied. It is further contended that due to miscalculation of dates, he could not file praecipe for extension of time to remove office objections and the Petition got rejected.

Ld. Advocate appearing for the Applicant submits that that he will pursue with the captioned Petition diligently if it is restored to file. Statement is accepted.

Reasons mentioned in the Affidavit appear to be genuine. Considering grounds mentioned in the Affidavit of the Applicant, I am of the view that the Applicant has made out a case for restoration of captioned Petition. In view thereof, present Chamber Order is granted as prayed and signed separately, upon payment of cost of Rs. 2,500/- to 'The High Court Employees Medical Welfare Fund at Mumbai' - Bank of India Mumbai (Main) Branch, Account No. 000120110001337, IFSC Code : BKID0000001, to be paid within one week from today.
