By this Chamber Order the Plaintiff seeks liberty to serve the Writ of Summons upon the Defendant No. 2 viz. Harsh Kumar Singh by way of substituted service by publication and pasting. 2.

Perused the affidavit in support. Ld. Advocate for the Applicant submits that, the Writ of Summons sent for service upon Defendant No. 2 Harsh Kumar Singh through the Sheriff of Bombay was returned by postal authority with remark "No such person in the said address" and bailiff has filed an affidavit of service dated 26th July, 2024. He, therefore, prays that Plaintiff be permitted to serve the writ of summons by way of substituted service by publishing in two newspapers viz. in "Free Press Journal" in English language and "Navshakti" in vernacular language i.e. Marathi having circulation in Mumbai.

For the reasons stated in the Affidavit in support the Chamber Order is allowed and the same is signed separately.. Plaintiff is directed to publish the writ of summons by publishing in two newspapers i.e. in "Free Press Journal" in English language and "Navshakti" in vernacular language i.e. Marathi as per schedule

Registry is directed to issue fresh writ of summons, if required.
