By this Chamber Order, the Applicant/Plaintiff seeks service of Writ of Summons upon (1) Vipul Juria, Defendant No. 3 and (2) Shanu Garg, Defendant No. 4 by way of substituted service as per schedule annexed to the Chamber Order. 2.

Perused the affidavit in support and affidavit of service filed by bailiff.

Heard. Ld. Advocate for the Applicant / Plaintiff submits that the writ of summons sent for service upon Defendant Nos. 3 and 4 through the bailiff could not be served and the bailiff has submitted the report that, the premises of the Defendant Nos. 3 and 4 were found locked. The Bailiff has further reported that, upon making inquiry it was informed that, the Defendant Nos. 3 and 4 had sold the premises. Ld. Advocate for the Applicant / Plaintiff therefore prays that the Plaintiff / Applicant be permitted to serve the writ of summons by way of substituted service in publishing two newspapers viz. "Free Press Journal" in English language and "Navshakti" in vernacular language i.e. Marathi widely circulated in Mumbai.

For the reasons stated in the affidavit in support the Chamber Order is allowed and the same is signed separately. Applicant / Plaintiff is directed to publish the writ of summons in two newspapers "Free Press Journal" in English Language and "Navshakti" in vernacular language i.e. Marathi within four weeks from today and file affidavit of publication within two weeks thereafter.
