13. CHOL/476/2025 IN TP(L)/10096/2022 P.C. : The present Chamber Order is e-filed by the Applicant for restoration of the Petition as vide Order dated 27.03.2024, Petition got rejected under O.S.Rule 986 for non-compliance of office objections.

Heard Ld. Advocate for the Applicant. Perused Affidavit in support of Chamber Order. It is contended therein that vide conditional Order dated 27.03.2024, Applicant was directed to remove office objections. However, the earlier Advocate for the Applicant failed to comply office objections and the matter got rejected. The Applicant appointed new Advocate and obtained certified copy of Petition on 11.06.2025; as the earlier Advocate did not returned papers inspite of repeated requests. For the reasons stated above, there is a delay of 464 days in filing present Chamber Order.

Ld. Advocate for the Applicant submits that he will pursue captioned Petition diligently and therefore, prays that delay caused in filing present Chamber Order may be condoned and Chamber Order may be allowed.

Reasons mentioned on oath, as above, appears to be bonafide. Therefore, I am of the view that the Applicant has made out a case for restoration of captioned Petition. In view thereof, present Chamber Order is granted as prayed.
