CHOL/477/2025 IN EXA(L)/11578/2024 P.C. : The present Chamber Order is taken out by the Applicant for setting aside Order dated 12.03.2025, rejecting captioned Execution Application under O.S.Rule 986 for noncompliance of office objections. Ld. Advocate for the Applicant submits that the respondents were served with the Chamber Order. Affidavit of Service showing service upon other side is taken on record.

Despite service, none appeared for and on behalf of the Respondents.

Heard Ld. Advocate for the Applicant. Perused Affidavit in support of the Chamber Order. It is contended that the primary objections pertain to certified copy of Award, computation of awarded sum and replacement of illegible annexures and now all the required documents have been procured and ready to file. It is further averred that delay of 97 days caused in filing present Chamber Order is inadvertent and unintentional caused due to reasons beyond control.

Ld. Advocate for the Applicant submits that now, he will pursue captioned Application diligently and therefore, prays that delay caused in filing present Chamber Order may be condoned and Chamber Order may be allowed.

Reasons mentioned on oath, as above, by the applicant remain uncontested for want of resistance from the Respondents' side. Therefore, .... 2

In view thereof, present Chamber Order is granted as prayed and signed separately upon payment of cost of Rs. 5,000/- within three days to 'The High Court Employees Medical Welfare Fund at Mumbai' - Bank of India Mumbai (Main) Branch, Account No. 000120110001337, IFSC Code : BKID0000001.

The Applicant to remove office objections on the Application and get the same registered and/or numbered within two weeks from the date of payment of cost, failing Application to stand rejected for non-compliance of office objections under O.S.Rule 986.
