15. CHOL/489/2025 IN TP(L)/13506/2024 P.C. : The present Chamber Order is e-filed by the Applicant for restoration of the Petition, as vide Order dated 11.07.2025, Petition got rejected under O.S.Rule 986 for non-compliance of office objections.

Heard Ld. Advocate for the Applicant. Perused Affidavit in support of Chamber Order. It is contended therein that when the matter was listed before this Authority on 11.07.2025, Advocate could not attend the matter due to his personal difficulty and ill health. Further, original Death Certificate of the deceased was not traceable and hence, new Death Certificate was obtained from Rajkot Municipal Corporation. Hence, Applicant has prayed for restoring the Petition by granting present Chamber Order.

Ld. Advocate for the Applicant submits that he will pursue captioned Petition diligently if the Chamber Order is granted.

Reasons mentioned on oath, as above, appears to be bonafide. Therefore, I am of the view that the Applicant should get one opportunity to pursue with the captioned Petition. In view thereof, present Chamber Order is granted as prayed.

The Petitioner to remove office objections on the Petition and get the same registered and/or numbered on or before 28.10.2025, failing Petition to stand rejected for non-compliance of office objections under O.S.Rule 986.
