Trilegal, Advocate for Plaintiff S(L)/29440/2024 ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) P.C. : The present Chamber Order is taken out by the Applicant for setting aside Order dated 18.06.2025, rejecting captioned Suit under O.S.Rule 986 for noncompliance of office objections. Ld. Advocate for the Applicant submits that the Defendants were served with the Chamber Order as per Affidavit of Service, which is on record. Despite service, none appeared for and on behalf of the Defendants.

Heard Ld. Advocate for the Applicant. Perused Affidavit in support of the Chamber Order. It is contended that vide conditional Order dated 18.06.2025, Applicant was directed to remove office objections within four weeks. However, considering the voluminous objections and since the Plaintiff was in process of changing Advocate, office objections remained to be complied. It is further averred that delay of 80 days caused in filing present Chamber Order may be condoned and Chamber Order may be allowed. It is further stated that grave prejudice and irreparable loss will cause to the Plaintiff if Chamber Order is not allowed.

Ld. Advocate for the Applicant submits that now, he will pursue captioned Suit diligently and therefore, prays that delay caused in filing present Chamber Order may be condoned and Chamber Order may be allowed.

Reasons mentioned on oath, as above, by the applicant remain uncontested for want of resistance from the Defendant's side. Therefore, I am of the view that the Applicant has made out a case for restoration of captioned Suit.

) ) ) ) ) ) ) ) ) ) ) ) In view thereof, present Chamber Order is granted as prayed upon payment of cost of Rs. 5,000/- to 'The Bombay Bar Association's Charitable Trust' be paid within three working days from the date of uploading of this order. Chamber Order is signed separately. Upon payment of cost as mentioned above, the Applicant to remove office objections on the Suit and get the same registered and/or numbered within two weeks from the date of payment of cost, failing Suit to stand rejected for non-compliance of office objections under O.S.Rule 986.
