Rule 986 for non-compliance of office objections.
Perused Affidavit in Support of the Chamber Order. It is contended therein that due to difficulty of the Advocate on record and his clerk, office objections remained to be complied and the matter got rejected under OS Rule 986. It is further averred that thereafter, he took out Chamber Order but due to personal difficulty and old age, the same got misplaced. Therefore, there is delay of 271 days in taking out the Chamber Order. Hence, he has prayed to restore the Petition to its original file by condoning delay of 271 days.
Reason mentioned in the Affidavit-in-Support appears to be bonafide, and substantial justice cannot be denied on technical grounds. Further, the Applicant has explained delay, as above, satisfactorily. Therefore, the Applicant should get one opportunity to pursue with the captioned Petition.
In view thereof, delay of 271 days, caused in filing present Chamber Order, is condoned and the present Chamber Order is granted as prayed.
Petitioner to remove office objections on the Petition and get the same registered and/or numbered within four weeks from the date of uploading of order, failing the Petition to stand .... 2
