16. CHOL/536/2025 IN WP(L)/15316/2023 P.C. : The present Chamber Order is taken out by the Applicant for restoring the captioned Petition which was rejected vide Order dated 25.03.2025 under O.S.Rule 986 for non-compliance of office objections.

Heard Ld. Advocate for the Applicant. Perused Chamber Order and Affidavit in support of the Chamber Order. It is contended therein that vide conditional Order dated 25.03.2025, Applicant was directed to remove office objections within four weeks. However, as the Applicant is super senior citizen and not much conversant with the use of email or computer or mobile, it took some time to provide necessary details to remove office objections and in the meantime, the Petition stood rejected under OS Rule 986. For the aforesaid reason, there is delay of 150 days in filing present Chamber Order. It is further stated that delay was neither willful nor deliberate, hence, present Chamber Order may be granted by condoning delay.

Ld. Advocate for the Applicant submits that now, he will pursue captioned Petition diligently and therefore, prays that delay caused in filing present Chamber Order may be condoned and Chamber Order may be allowed.

In view of above, I am of the view that the Applicant has made out a case for restoration of captioned Petition.

In view thereof, delay of 150 days caused in filing Chamber Order is condoned and the present .... 2
