CHOL/543/2025 IN TP(L)/30855/2022 ) ) ) Mr. Pramod Kumar Shrivastava, Applicant present in person ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) P.C. : The present Chamber Order is e-filed by the Applicant for setting aside Order dated 24.04.2024, rejecting captioned Petition under O.S. Rule 986 for non-compliance of office objections.

Perused Affidavit in Support of the Chamber Order. It is contended therein that due to medical treatment of the Applicant, he could not remove office objections in time. Further, during the same period, Applicant had filed Criminal Writ Petition in Hon'ble Supreme Court of India to get the return of properties of himself and his wife (deceased). It is further averred that due to some conditions beyond his control, Applicant could not file Chamber Order within time and hence, there is delay of five months in taking out captioned Chamber Order.

Ld. Advocate for the Applicant submits that delay caused in filing present Chamber Order may be condoned and captioned Petition may be restored to file.

Reason mentioned in the Affidavit-in-Support appears to be bonafide, and substantial justice cannot be denied on technical grounds. Further, the Applicant has explained delay, as above. Therefore, the Applicant should get one opportunity to pursue with the captioned Petition. In view thereof, delay of five months, caused in filing present Chamber Order, is condoned and the present Chamber Order is granted as prayed.
