The present Chamber Order is e-filed by the applicant for setting aside Order dated 08.01.2025, rejecting captioned Caveat under O.S.Rule 986 for non-compliance of office objections.

Ld. Advocate for the applicant tenders Affidavit of Service. Ld. Advocate is directed to file it in the department.

Heard ld. Advocate for the applicant. Perused Affidavit in Support, contents of which are self-explanatory. It is contended that office objections were complied with, however, same were remained to be scrutinized. It is further contended that office objections with respect to age and nationality of caveator, which were raised subsequent to passing of Order dated 08.01.2025, could not be removed in time due to technical difficulty faced on e-filing portal. It is further contended that inadvertently, delay of 78 days caused in filing present Chamber Order since the applicant was under bonafide impression that office objections were complied with. Therefore, it is prayed that captioned Caveat may be restored to file by condoning delay.

Ld. Advocate for respondent submitted for passing appropriate orders in the matter.

Reasons mentioned in the Affidavit, appear to be genuine and substantial justice cannot be denied technical ground. In my view, the applicant should get one opportunity to pursue

CHOL/544/2025 in CTSL/16387/2024 ) ) ) ) ) ) ) ) ) ) ) ) ) ) with captioned Caveat. No prejudice would cause to the respondent since he can contest the matter on its own merits. Hence, in the interest of justice, delay of 78 days caused in filing present Chamber Order is condoned and present Chamber Order is granted as prayed.

The caveator to remove office objections of Caveat and get the same registered and/or numbered by filing/uploading compliance praecipe within two weeks from the date of uploading of order, failing Caveat to stand rejected for non-compliance of office objections under O.S.Rule 986.
