65. CHOL/547/2025 IN Ms. Shruti Parmar i/b. M/s. RJ Law, Advocate for Respondent ARBP(L)/5289/2024 P.C. : The present Chamber Order is taken out by the Applicant for setting aside Order dated 21.03.2025, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.

Heard Ld. Advocate for the Applicant. Perused Affidavit in Support of the Chamber Order. It is contended therein that as the concerned clerk left the firm without informing them, the office objections raised in the Petition remained to be complied and the Petition got rejected as per conditional order dated 21.03.2025. It is further stated that there is no intentional inaction on the part of the Applicant.

It is informed that there is delay of 119 days in filing the present Chamber Order.

Ld. Advocate for Respondent, on instructions, made a statement that she waives service of Chamber Order. She further made a statement that she has no objection if the Chamber Order is granted, by condoning delay, if any. Statements are accepted.

Ld. Advocate for Applicant prays for granting present Chamber Order by condoning delay of 119 days in filing present Chamber Order.

In view of above, I am of the opinion that one opportunity is required to be given to the Applicant to pursue with the captioned Petition. Moreover, Ld. Advocate for Respondent has .... 2

Hence, for the reasons stated in the Affidavit, present Chamber Order is granted as prayed by condoning delay of 119 days in filing the present Chamber Order.

Petitioner to remove office objections on the Petition and get the same registered and/or numbered within two weeks from the date of uploading of order, failing the petition to stand rejected for non-compliance of office objections under O.S.Rule 986.
