Wadia Ghandy & Co., Advocate for Defendant No. 2 P.C. : The present Chamber Order is taken out by the Applicant for setting aside Order dated 03.04.2025, rejecting captioned Suit under O.S.Rule 986 for non-compliance of office objections.

Ld. Advocate for Defendant Nos. 1 filed Reply to the Chamber Order. The same is taken on record. Ld. Advocate for Defendant No. 2 also filed Reply to the present Chamber Order. The same are taken on record. Ld. Advocate for Defendant No. 2 submits that the said Reply may be considered as argument.

Heard Ld. Advocate for the Applicant. Perused Affidavit in Support to the Chamber Order. It is contended that due to maternity leave of erstwhile Advocate, Applicant could not obtain NOC and hence, the present Advocate did not have complete papers and proceedings of the matter due to which, office objections could not be complied within time and the captioned Suit got rejected.

Ld. Advocate for the Applicant submits that she will pursue with the captioned matter diligently if .... 2

it is restored to file, hence, present Chamber Order be granted by condoning delay of 115 days.

In view thereof, present Chamber Order is granted, as prayed, by condoning delay of 115 days, upon payment of cost of Rs. 5,000/- each to Defendant No. 1 and Defendant No. 2 be paid within three working days from the date of uploading of this order. The Chamber Order is signed separately.

Upon payment of cost as mentioned above, the Applicant to remove office objections on the Suit and get the same registered and/or numbered within two weeks from the date of payment of cost, failing the Suit to stand rejected for noncompliance of office objections under O.S.Rule 986.
